Compromise Agreement
WEST LONDON COMPROMISE AGREEMENT SOLICITORS
Compromise agreements
A compromise agreement might be offered in the event your employment is terminated. They are offered on the basis that you give up your right to pursue any legal claims against the employer in exchange for the payment of a certain some of money and benefits. Compromise agreements are offered in a wide range of circumstances including, but not limited to redundancy; cases where employees do not wish to return to work after taking maternity/paternity leave; where the termination has arisen as a result of some underlying and unresolved grievance and where employees are unfit to continue working.
Benefits of a compromise agreement
The benefit of a compromise agreement is the fact that provisions for legal costs are made and the underlying reason behind the agreement does not necessarily impact on the financial/benefits package offered. You should note that a compromise agreement is not legal unless you seek independent legal advice, and if you choose to seek advice from a solicitor, the employer will pay your costs.
What we can do to help
We have years of experience in advising clients on compromise agreements and negotiating the best possible deal.
We will also advise you on alternatives to compromise agreements. It could be the case you were forced to leave your job due to circumstances created by the employer. This is known as constructive unfair dismissal and by asserting this claim, the agreement could be negotiated more in your favour or you could take your employer to an employment tribunal. In any case, we will fully advise on the costs and benefits of any courses of action you choose to take.
